Snippet A – Window Responsibility

Based on Colina’s governing documents, windows and sliding glass doors are treated as owner-responsibility components, not association-maintained common area. The HOA was never funded or structured to replace every window and slider in the project, including stucco cuts, flashing, waterproofing, and exterior restoration on each opening.

A prior administration obtained a staff attorney “opinion” letter suggesting the association might be responsible for window replacement. That letter:

  • Does not rely on clear CC&R language assigning windows to the HOA;
  • Is circular and non-committal in its reasoning; and
  • Is not a formal CC&R amendment or funding plan approved by the membership.

Going forward, unless and until the CC&Rs are formally amended and properly funded: windows and sliding glass doors remain the individual owner’s responsibility to maintain and replace.

Snippet B – Patios, Plants & Pets on Balconies

Many patios and balconies at Colina are directly above another unit or tied into wall and deck drainage. The surface that feels like “your patio” is often your neighbor’s ceiling or a waterproofed structural deck. Those drains are a last line of defense, not a garden system.

  • No balcony gardens: Residents may not create gardens, planter beds, or large plant collections on balconies or patios. Soil, excess water, and roots overload the deck, clog drains, and increase leak and mold risk.
  • Optional minimal plant allowance: If the Board allows any plants: at most four (4) potted plants per balcony, each no more than 10" wide, in deep waterproof saucers that fully capture water. Anything beyond that is at the owner’s risk, and damage to membranes may be charged to that owner.
  • No pet bathroom use: Pets may not use balconies or patios as bathroom areas. Urine, feces, and grooming waste going into balcony drains are a health hazard and damage waterproofing, and are subject to fines and cleanup charges.
  • Regular inspections: The association may perform periodic balcony/patio inspections and bill owners for misuse-related damage, including at escrow.

Snippet C – Sales, Rentals & Inspections

When a unit is sold or newly rented, Colina uses a formal registration and inspection process to protect the buildings, keys, parking, and water usage.

  • Owners must register the sale through the portal before ordering resale docs and pay a $150 escrow inspection fee online.
  • A pre-sale inspection covers entry, balcony/patio, visible plumbing and electrical, doorbells and cameras, and the unit’s assigned garage and parking space(s) to document oil spills, wear, and altered fixtures.
  • For rentals, a move-out inspection is required before a new tenant moves in. Move-out / rental turnover carries a $500 fee paid online.
  • Only one move-in or move-out per day is permitted so the association can inspect trash/dumpster areas and tie any mess or damage to the correct party.
  • Running toilets and obvious leaks are flagged; a single running toilet can waste around 200 gallons per day (~73,000 gallons per year).

Snippet D – Pet Registration & Limits

All pets must be registered with the association to be permitted on the grounds. Registration includes owner and unit info, type of animal, breed, description, and emergency contact.

  • Owners must provide proof of current vaccinations and, for dogs, any required city/county license.
  • Pets are subject to size/weight limits and a maximum number per unit as set by the Board.

  • Pets must be on leash and under control in all common areas, and owners must immediately clean up pet waste.
  • On-site dog walkers / pet services must follow all rules; repeated issues may result in limits on that activity.

Snippet E – Dog Waste Stations & Poo Bags

Dog waste stations and poo bags are provided as a courtesy for responsible resident pet owners, not as a free service for the surrounding neighborhood. The cost of bags, hauling and cleaning comes out of HOA dues.

  • Stations are intended for registered Colina pets only. Abuse by outside users may lead to stations being relocated, reduced, or more tightly controlled.
  • Owners must pick up dog waste immediately, every time, anywhere on the property.
  • Excessive use and cleanup are real costs. Repeated violations may bring fines, cleaning charges, and possible loss of pet privileges.

Snippet F – Parking Placards & Vehicle Registration

Colina is moving to a full registration model for parking: every car must be known and tied to a registered unit.

  • No registration = no placard = no parking. Owners and residents must complete the online vehicle registration before any placard or access code is issued.
  • Commercial-grade reflective placards or hang-tags must be displayed at all times, even in deeded spaces.
  • Every owned vehicle (make, model, color, license plate) is recorded in a central smart sheet so the association knows every car on site.
  • Placards and access can be revoked or deactivated for rule violations or failure to keep info current.

Snippet G – Architectural Requests ($75 Fee)

All architectural changes (windows, doors, exterior finishes, satellite dishes, etc.) require a formal application and carry a $75 non-refundable processing fee per request.

  • Applications without the $75 fee are incomplete and will not be reviewed.
  • Owners must attach plans, photos, and any required specs.
  • Approval is required before work begins; unauthorized work may be subject to removal and fines.

Selling or Renting – Registration

Before selling your unit or changing tenants, you must register through this portal, pay the applicable fee, and (for sales) obtain a Colina Sale Code.

Sale / Pre-Sale Registration

Use this section to register your upcoming sale before you order resale documents (HomeWiseDocs, etc.). Registration includes scheduling the HOA’s pre-sale inspection and paying the escrow inspection fee.

Escrow inspection fee: $150 (paid online by credit card).

As part of the pre-sale inspection, the association will also inspect any garage assigned to the unit and the associated parking space(s). This is mandatory for all sales.

  • Oil spills and oil residue in garages and parking stalls will be documented and disclosed.
  • Extra wear and tear, damaged surfaces, and altered fixtures or electrical abuse will be noted.
  • Findings may be used to charge repair costs to the seller and will be included in escrow disclosures.

After you complete registration and the Stripe payment is successful, the system will issue a unique 7-character alphanumeric "Colina Sale Code".

You must provide this code to your escrow / agent and enter it when ordering your resale documents. Without a valid Colina Sale Code, the association will not release documents through HomeWiseDocs or any equivalent service.

Tenant Move-Out / New Tenant Registration

Use this section to register a tenant move-out and schedule the HOA’s move-out inspection before a new tenant moves in. This allows the association to document balconies, patios, garages, keys, and common-area interfaces at turnover.

Move-out / rental turnover fee: $500 (paid online by credit card).

Move scheduling rule: Colina allows only one move-in or move-out per day. Your move date must be reserved in advance. This lets the association inspect the garbage / dumpster areas and paths of travel after your move is complete and clearly tie any damage or illegal dumping to the correct party.

Once registration and payment are completed, management will confirm your inspection appointment, key return instructions, and any required forms for the new occupant.

  • Owners and residents must complete the online vehicle registration form before any parking placard or access code is issued. Unregistered vehicles are not authorized to park within the community.
  • Commercial-grade reflective placards or hang-tags must be displayed at all times, even in deeded spaces. Placards are association property and can be revoked or deactivated for rule violations or failure to update information.
  • Every owned vehicle (make, model, color, license plate) is recorded so the association knows exactly who is parked on site.
  • When a unit sells or a tenant moves out, existing placards and access codes are cancelled. New owners/tenants must register and obtain new placards before using the parking areas.
